These Terms of Service ("Terms") govern your access to and use of the Firelize desktop application (the "Software"), our website firelize.com, account management portal, and any related services (collectively, the "Services") provided by Brave & Hungry GmbH ("Brave & Hungry", "we", "us", or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
By downloading, installing, accessing, or using the Software or Services, you affirm that you are at least 16 years old (or the age of legal majority in your jurisdiction if different) and capable of entering into a binding agreement, and you agree to comply with these Terms, our Privacy Policy, and our End-User License Agreement (EULA).
Firelize is a desktop application designed to support software engineers developing applications on Firebase. Its features include, but are not limited to, a database editor for Firestore (allowing users to browse, add, and edit data), and planned support for Firebase Auth (managing users) and Firebase Storage (managing files). The Software operates locally on your machine and interacts with your Firebase projects via Firebase SDKs and APIs.
Due to the availability of a free trial without any functional limitations, which allows users to thoroughly test Firelize before making a financial commitment, we do not offer refunds. However, we are committed to customer satisfaction and will consider refund requests on a case-by-case basis if a user encounters significant problems that prevent them from using the Software as intended, provided such issues are reported promptly.
Your use of the Firelize desktop application is subject to our End-User License Agreement (EULA), which is incorporated herein by reference. The EULA grants you a limited, non-exclusive, non-transferable, revocable license to use the Software in accordance with its terms. Each license is for a single user.
You agree to use the Services only for lawful purposes and in accordance with these Terms.
You are solely responsible for all data, information, and content you manage, edit, or interact with using Firelize in your Firebase projects.
You acknowledge that Firelize interacts with your Firebase projects via Firebase APIs. Operations performed by Firelize (e.g., reading, writing, exporting data) may incur costs on your Firebase account based on your Firebase usage and billing settings. You are solely responsible for monitoring your Firebase usage, understanding Firebase pricing, and managing any costs incurred. Brave & Hungry GmbH is not liable for any Firebase charges resulting from your use of the Software.

The Services, including the Software, website, logos, visual design, and all underlying technology and content (excluding your Firebase project data), are and will remain the exclusive property of Brave & Hungry GmbH and its licensors. The Services are protected by copyright, trademark, and other laws of Germany and foreign countries.
Firelize is designed to interact with Firebase, a third-party service provided by Google. Your use of Firebase is subject to Google's terms and privacy policies. Brave & Hungry GmbH is not responsible for the Firebase service, its availability, or its actions.
Our data practices are described in our Privacy Policy, which is incorporated by reference. By using the Services, you consent to those practices.
THE SERVICES AND SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRAVE & HUNGRY GMBH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED. WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BRAVE & HUNGRY GMBH, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) RESULTING FROM:
YOU ARE SOLELY RESPONSIBLE FOR ANY CONSEQUENCES OF USING FIRELIZE. YOU ACKNOWLEDGE THAT YOUR FIREBASE ACCOUNT AND USAGE REMAIN UNDER YOUR CONTROL, AND YOU ARE RESPONSIBLE FOR ANY OPERATIONS INITIATED BY FIRELIZE THROUGH YOUR AUTHORIZATION.
FIRELIZE PERFORMS CERTAIN OPERATIONS VIA THE FIREBASE API, INCLUDING READING AND WRITING DATA. THESE OPERATIONS MAY TRIGGER USAGE-BASED BILLING BY FIREBASE. IT IS YOUR RESPONSIBILITY TO MONITOR YOUR FIREBASE USAGE AND ACCOUNT CONFIGURATION. BRAVE & HUNGRY GMBH IS NOT LIABLE FOR ANY COSTS, OVERAGES, OR DAMAGES RESULTING FROM USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO UNINTENDED READS, WRITES, OR LOOPING OPERATIONS.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES OR SOFTWARE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (II) ONE HUNDRED EUROS (€100).
We may terminate or suspend your access to the Services, including your license to use the Software, immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
You can terminate your account and subscription at any time by contacting support at hey@firelize.com or through your account settings, if available.
Provisions that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 14 days' notice prior to any new terms taking effect. Notification will be provided via email to the address associated with your account or through a notice within the Services. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
All disputes arising out of or in connection with these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the competent courts in Kempten (Allgäu), Germany. We do not participate in online dispute resolution procedures before consumer arbitration boards.
These Terms, together with our Privacy Policy and End-User License Agreement, constitute the entire agreement between you and Brave & Hungry GmbH concerning the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Brave & Hungry GmbH to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null. We may freely assign or transfer these Terms without restriction.
